Terms of Service

1. Definitions

• Platform: the website, application and other services operated by Connekit, including the media kit editor, public pages and associated integrations.
• Creator: an individual who creates a Connekit account to build and publish a Media Kit.
• Visitor: anyone who accesses a Media Kit's public page without needing to create an account (e.g. brand representatives).
• Media Kit: the public profile page generated by Connekit from the information provided by the Creator and data obtained through authorized integrations (e.g. Instagram).
• Account: the personal, non-transferable registration that gives a Creator access to the Platform's private area.

2. Eligibility

To create an Account, you must be at least 18 years old or have reached the age of legal majority in your jurisdiction, whichever is greater. By signing up, you represent and warrant that you meet this requirement and that the information you provide is true, complete and up to date.

Connekit may refuse, suspend or terminate accounts that violate this requirement or that were created with false information.

3. Account and user responsibilities

• You are responsible for keeping your access credentials confidential and for all activity carried out through your Account.
• You must notify us immediately of any unauthorized use of your Account or any other security breach.
• You are responsible for the accuracy of the information you publish on your Media Kit, including bio, business contact, partner brands and featured work.
• An Account is personal and may not be shared, sold or transferred to third parties without Connekit's prior authorization.

4. License to content published on Media Kits

You retain ownership of all content you submit to Connekit (avatar, cover image, bio, portfolio, presentation videos, links and other materials).

By publishing your Media Kit, you grant Connekit a worldwide, non-exclusive, royalty-free license, limited to the period your Account remains active, to host, store, reproduce and publicly display that content solely for the purpose of operating and making your Media Kit available (including generating thumbnails, caching and technical delivery optimizations).

This license is revoked when you remove a specific piece of content or when your Account is deleted, except for copies kept for a limited period in security backups or as required by law.

You represent that you hold the necessary rights to all content you publish and that you are solely responsible for ensuring it does not infringe third-party rights.

5. Connekit's intellectual property

The Platform, including its software, design, brand, logo, institutional copy and other elements (except content submitted by Creators), is owned by Connekit or its licensors and is protected by copyright, trademark and other applicable intellectual property laws.

You may not copy, modify, reverse engineer, create derivative works of the Platform, or use the "Connekit" brand or name without prior written authorization.

6. Plans, billing and refunds

Connekit offers a free trial period, followed by a recurring paid plan, as described on the pricing page in effect at the time of purchase.

Payments are processed by a third-party payment provider (currently Stripe). By providing your payment details, you agree to that provider's terms. Connekit does not store full credit card numbers.

Subscriptions renew automatically at the end of each billing cycle, for the same amount and frequency contracted, until cancelled. You may cancel automatic renewal at any time from your account area or by emailing support@connekit.me.

7. Acceptable use

By using Connekit, you agree not to:

• Publish illegal, defamatory or discriminatory content, or content that infringes third-party intellectual property rights;
• Impersonate another person, brand or entity, or create an Account on behalf of a third party without authorization;
• Send spam, unsolicited bulk messages, or use the Platform to distribute malware;
• Attempt to access, without authorization, the data, accounts or systems of other Creators or of the Platform itself;
• Reverse engineer, scrape at scale, or deliberately overload Connekit's infrastructure;
• Use the Platform in any way that violates Instagram/Meta's Terms of Use or those of other connected integrations.

8. Reliance on third-party integrations (Instagram/Meta)

A substantial part of Connekit's functionality depends on integrations with third-party platforms, currently Instagram, through the Instagram Graph API operated by Meta Platforms, Inc.

These integrations are outside Connekit's control. Outages, downtime, policy changes, rate limits, access revocation, or discontinuation of the API by Meta may fully or partially affect data syncing and the display of metrics on your Media Kit.

Connekit does not guarantee the continued availability of these integrations and is not liable for losses arising from the unavailability, alteration or discontinuation of third-party APIs.

Our use of data obtained via the Instagram Graph API is limited as described in our Limited Use Policy.

9. Service availability

Connekit is provided "as is" and "as available" during the product's current phase of continuous development. We may change, suspend or discontinue features at any time, with reasonable notice when the change materially impacts active Creators.

10. Limitation of liability

To the maximum extent permitted by applicable law, Connekit will not be liable for indirect, incidental, special, punitive or consequential damages, including lost profits, arising from the use or inability to use the Platform.

Nothing in these Terms excludes or limits rights that cannot be legally excluded or limited in relation to you, including rights guaranteed by the Consumer Defense Code when you are considered a consumer.

11. Termination

You may close your Account at any time from your account area or by emailing support@connekit.me.

Connekit may suspend or terminate your Account, with notice when possible, in the event of a breach of these Terms, fraudulent use, or as required by law.

After termination, your Media Kit is no longer publicly accessible and your data is handled as described in our Privacy Policy.

12. Governing law and venue

These Terms are governed, to the extent applicable, by the laws of Delaware, United States, without prejudice to consumer protection rules and other public-order rules applicable to users located in Brazil, which cannot be waived by contract.

For consumers located in Brazil, the venue of the consumer's domicile is guaranteed for resolving any disputes, under the Consumer Defense Code.

13. Data Processing Agreement (DPA)

For the processing of your Media Kit's Visitor data, in which you act as Controller and Connekit as Processor, our Data Processing Agreement (DPA) applies, publicly available at connekit.me/legal/dpa and automatically incorporated into these Terms. Questions can be sent to hello@connekit.me.

14. Changes to these Terms

We may update these Terms periodically. Material changes will be communicated by email or notice on the Platform with reasonable advance notice. Continued use of Connekit after an update's effective date constitutes acceptance of the new Terms.
